How Long Do You Have to File a Medical Malpractice Claim in Alabama or Tennessee?

When you trust a doctor, nurse, or hospital with your care, you expect to leave better off than when you arrived. When a medical error causes you harm instead, the physical, emotional, and financial toll can be overwhelming. Unfortunately, many patients don’t realize that the law sets strict time limits on medical malpractice claims, and Tennessee’s deadline is among the shortest in the country. Understanding how much time you have is one of the most important steps in protecting your right to compensation.

Medical Malpractice Filing Deadlines by State

Alabama

In Alabama, a medical malpractice lawsuit generally must be filed within two years of the act or omission that caused the injury. If the harm could not reasonably have been discovered within that window, the law allows six months from the date of discovery to file. However, Alabama also has a four-year statute of repose, which means that in most cases no claim can be brought more than four years after the malpractice occurred, even if the patient never knew about it. Special rules apply to young children: a child injured before age four generally has until their eighth birthday to file.

Tennessee

Tennessee’s deadline is even tighter. Health care liability claims generally must be filed within one year of the date the injury occurred or was discovered. Before filing, patients must also send written notice to every provider they plan to sue at least 60 days in advance. When that notice is properly given, the filing deadline is extended by 120 days. Tennessee also has a three-year statute of repose, with limited exceptions for cases involving fraudulent concealment or a foreign object left in the body.

Why Acting Early Matters

Medical malpractice claims require more preparation than many other injury cases. Medical records must be gathered and reviewed, and qualified medical experts are typically needed to explain how the standard of care was breached. In Tennessee, a certificate of good faith must also be filed with the complaint. Because this process takes time, waiting until a deadline is near can put your claim at serious risk. If the negligent treatment followed an on-the-job injury, a workers compensation attorney can help you understand how your benefits and any malpractice claim interact, and which deadlines apply to each.
